Over the years we have found that timeshare sale prices have depreciated due to numerous factors. Gone are the days when people could make a profit or even recoup their original timeshare purchase price. Unfortunately, due to more resorts now being available, worldwide fraud, points systems, the diminishing number of private buyers, rising maintenance fees, cheap holiday packages and internet travel agents, the resale value has reduced considerably.

Timeshare as ETOO states “is an investment in future holidays and not a financial gain”. Although timeshare can be classed as deeded real estate, it is important to remember that timeshare should not be considered an investment, and more like buying a car for example.

When purchasing direct from the resort, the original purchase price is at its highest, as up to 50% of the costs are used in the marketing of the sale.

Etoo Timeshare would like to rephrase part of the “Review of the Timeshare Directive” prepared by the European Commission (1996) to summarize their opinion regarding exchange of timeshare.
“The possibility of joining an exchange scheme is often used in the marketing of timeshare and /or points as a positive argument. The major problems seem to be related to “overselling” of the advantages and the possibilities, leaving consumers disappointed because the requested exchange is not available, the timeshare product they have is not of sufficient value to be exchanged for the “5 star luxury resort” shown in the marketing, or with unexpected high costs related to exchange, having to pay annual membership fees as well as fees related to search and use of exchange.”

In the United States of America a nationwide class action has been filed on behalf of the RCI Weeks Program members. Through its Weeks Program, also known as the RCI Exchange system, RCI offers its members the option of depositing their vacation week in the RCI spacebank to exchange it for a week of equivalent value from the same bank. RCI states that the vacation weeks deposited are held in the spacebank for exchanges. The official claim now is that RCI actually rents out the most desirable and highly demanded vacation weeks from its spacebank, thus depleting the most popular options available to Weeks Program members who seek exchanges. The class action is seeking an order stopping RCI from continuing this unlawful practice and for RCI to pass on (to the RCI Weeks Program members) all profits received in connection with renting out vacation weeks deposited for exchange in the spacebank, in addition to other monetary relief.

Consumers across the European Union will benefit from tougher holiday protection - when they buy and resell timeshare holidays, long-term holiday products, as well as exchange and resale - under new rules proposed by the European Commission on 7 June 2007.

The proposal for the new Directive will enhance consumer protection in all member states of the European Union by extending the scope of the current rules (of the 1994 European Union Timeshare Directive) to also include the new products which have emerged in the market. The proposal is to become effective by 2010.

One of the costs involved when purchasing timeshare is the annual management fees which covers the costs for grounds and housekeeping services, utilities, insurance, on-site management, maintenance, real estate tax, and financing improvement projects.

Fees vary and do increase yearly and will rise in accordance with inflation. However, fees are lower than what you would spend on a hotel room, but there can be hidden costs which people don’t always realise when buying their timeshare.

One off levies can be administered throughout the ownership legally, to cover additional expenses that are sometimes applicable such as new repairs, extensions, health club etc.., rather than accentuated yearly fees.

Some resorts change management companies in order to provide the best service; this sometimes explains the sudden increase in fees.

There are a number of reasons that people choose to sell their timeshare homes or apartments. Whatever your reason for selling, make sure that you make the most of this opportunity by following the tips below recommended by ETOO staff.

1. Get a realistic price

It’s important that you get a realistic price for your timeshare. By looking at the location, condition and situation of your timeshare, an experienced timeshare agency will be able to give you an accurate, realistic and achievable valuation that should help you to sell your timeshare quickly.

2. Use a reputable agency

Unfortunately, there are several unreputable agencies whose sole aim is to make money – and may not even be interested in selling your timeshare for you. Make sure that you choose an agency that has your interests at heart, by checking whether:

• The agency is a member of either the European timeshare governing bodies, or the International Timeshare Resale Association (ITRA)
• They are happy for you to have the resale contract checked by your solicitor
• They are happy to provide details of their service in writing

3. Check out advertising

Agencies will advertise your timeshare property for you, through a variety of media including newspapers and selected online sites.

4. Sort out your paperwork

When you bought your original timeshare, it would have come with its own paperwork. You will need this in order to resell your timeshare, and to pass onto the new owners. Make sure it is all in one place and in order before you start the selling process.

5.Keep track of your costs

There is a cost associated with selling your timeshare. The agency will take a fee and you may also need to pay a solicitor to check the contract. Make sure you are aware of all the costs you will incur, both to help you decide whether it’s worth selling your timeshare, and to ensure that you don’t overspend.
